4. User Registration and Accounts

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

You represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you are not under the age of 13; (5) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Services.

5. AI-Generated Content and Technology

AI Service Dependencies: Our services rely on third-party AI providers:

• OpenAI API: For image generation and content optimization
• Google Veo3 API: For AI video generation
• Social Media APIs: X (Twitter) and YouTube for content publishing

Content Responsibility: Users of the platform are solely responsible for any actions they take in relation to the content generated by our AI, including but not limited to sharing, distribution, interpretation, and decision-making based on the content. You acknowledge that AI-generated content may be inaccurate, inappropriate, offensive, or not suitable for certain audiences.

By using the platform, users acknowledge and agree that they understand the limitations of AI-generated content and will not hold Soul AI LLC, or their respective partners, affiliates, officers, directors, agents, and employees liable for any consequences, damages, or claims arising from the content or actions taken based on the content.

6. Social Media Integration and Publishing

Account Authorization: To publish content to social media platforms, you must authorize Creator AI to access your accounts. You are responsible for:

• Ensuring you have the right to publish content to connected accounts
• Complying with each platform's terms of service and community guidelines
• Managing your social media account settings and permissions
• Monitoring published content and its reception

Publishing Responsibility: When you use our service to publish content:

• You retain full responsibility for all published content
• You are responsible for compliance with platform-specific rules and regulations
• You acknowledge that published content becomes subject to the terms and policies of the respective social media platforms
• You understand that we cannot control how platforms or audiences respond to your content

7. Usage Limits and Beta Testing

Beta Service Limits: Creator AI is currently in beta testing with the following usage limits:

• X Posts: 5 posts per user during beta period
• Video Generation: 3 videos per user during beta period

These limits may change without notice. Attempting to circumvent usage limits may result in account suspension or termination.

8. Intellectual Property

All content on the Creator AI website and application, including but not limited to text, graphics, logos, images, and software, is the property of Soul AI LLC or its content suppliers and is protected by international copyright laws. Unauthorized use of this content is prohibited.

User-Generated Content: You retain ownership of your prompts and any content you create using our services. However, by using our services, you grant us a limited license to process your prompts through third-party AI services as necessary to provide our services.

AI-Generated Content: Content generated by AI may not be eligible for copyright protection. You are responsible for determining the intellectual property status of any AI-generated content you use or publish.

9. Privacy Policy

10. Limitation of Liability

AI CONTENT LIABILITY: SOUL AI LLC SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR HARM ARISING FROM:

• The use of AI-generated content, recommendations, or suggestions provided through the Services
• Inaccuracies, errors, or inappropriate content generated by AI systems
• Third-party AI service failures, limitations, or data handling
• Content published to social media platforms and subsequent reactions or consequences
• Intellectual property issues related to AI-generated content
• Platform policy violations or account suspensions on connected social media accounts

SOCIAL MEDIA LIABILITY: SOUL AI LLC SHALL NOT BE LIABLE FOR:

• Content published to your social media accounts through our services
• Responses, reactions, or consequences of published content
• Social media platform policy violations or account restrictions
• Changes to social media platform APIs or terms of service
• Loss of social media followers, engagement, or reputation

MAXIMUM LIABILITY: NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, SOUL AI LLC'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

11. Indemnification

You agree to defend, indemnify, and hold harmless SOUL AI LLC, including its subsidiaries, affiliates, and all of their respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of:

• Your use of the Services
• Breach of these Legal Terms
• Any breach of your representations and warranties set forth in these Legal Terms
• Your violation of the rights of a third party, including but not limited to intellectual property rights
• Any actions taken based on AI-generated content or recommendations
• Content published to your social media accounts through our services
• Violations of social media platform terms of service or community guidelines
• Any claims arising from your use of third-party AI services through our platform
• Any harm or damage to any person or property arising from your use of our services

12. Third-Party Services and APIs

Creator AI integrates with several third-party services and APIs. Your use of these services through our platform is subject to their respective terms of service:

• OpenAI API: Subject to OpenAI's Usage Policies and Terms of Service
• Google Services (Veo3, Firebase): Subject to Google's Terms of Service
• X (Twitter) API: Subject to X's Developer Agreement and Terms of Service
• YouTube API: Subject to YouTube's Terms of Service and API Services Terms of Service

We are not responsible for any changes, limitations, or discontinuation of these third-party services.

13. Service Availability and Performance

We strive to provide reliable service but cannot guarantee:

• Uninterrupted availability of our services
• Consistent performance of AI-generated content quality
• Availability or performance of third-party AI services
• Successful publishing to social media platforms
• Compatibility with all devices or browsers

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles.

15. Changes to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates.

16. Termination

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Legal Terms or of any applicable law or regulation.

Upon termination, your right to use the Services will cease immediately, and we may delete your account and all associated data.

Beta Service Notice: Creator AI is currently in beta testing. By using our services, you acknowledge that:

• The service is provided "as is" during the beta period
